When leaders push the limits of executive power to enact sweeping financial measures, legal challenges are almost certain to follow. Now, a major courtroom showdown is unfolding over federal trade authority, reports DR News.
States take action
A large coalition of US states has launched a joint lawsuit against President Donald Trump’s administration. According to DR, 25 states filed legal papers on Monday in an effort to strike down new import duties introduced in July.
The measures impose tariffs between 10 and 12.5 percent on goods from 60 trading partners, including the European Union. White House officials justified the policy by pointing to forced labor abuses abroad.
However, state leaders view that claim as a legal cover. In a statement posted on her office website, New York Attorney General Letitia James slammed the new levies.
“After losing the case in the Supreme Court, the administration is once again illegally trying to raise taxes on families and businesses with a new round of tariffs,” James stated.
Pushing legal limits
“Regardless of how the administration tries to justify it, it is clear in the law and our Constitution that the President does not have the power to impose sweeping tariffs on precisely the countries he desires.”
The lawsuit was submitted to the US Court of International Trade in New York City. Smaller American companies have also filed similar challenges, as reported by Reuters.
The White House defended its position against the legal attack. As reported by CBS News, White House spokesperson Kush Desai stood by the administration’s tariff strategy.
“When a foreign country fails to establish and enforce an effective ban on the import of goods produced through forced labor, it is unfair and burdens American commerce, including American workers,” Desai said in a statement to the media.
Pattern of battles
This lawsuit reflects a recurring conflict over presidential trade powers. On February 20, the US Supreme Court ruled that most of Trump’s broadest tariffs were unlawful, prompting the president to impose temporary global duties under alternative statutes.
Those temporary measures were later invalidated by federal trade judges. With this newest legal battle underway, state leaders remain determined to block the administration’s economic policy in court.
