Supreme Court sides with Trump in case that could violate constitutional rights

The POTUS gets backing from the Supreme Court in controversial suggestion.

Another legal battle tied to Donald Trump’s immigration agenda landed before the US Supreme Court on Tuesday — and once again, the administration walked away with a win.

According to Reuters, case centered around a controversial policy limiting what federal immigration judges are allowed to publicly say about immigration issues while working for the government.

Policy was originally introduced during Trump’s first presidency back in 2017 and requires judges to seek approval before participating in speeches, events or public discussions connected to immigration policy.

Immigration judges and free-speech advocates argue the restrictions violate constitutional protections under the First Amendment.

Supreme Court Avoids Main Constitutional Question

Despite siding with Trump’s administration, the Supreme Court did not directly decide whether the policy itself is legal.

Justices instead focused on procedural questions surrounding how the case should move through the court system.

Trump’s administration argued the dispute belonged inside federal administrative channels rather than regular courts.

Lower courts had previously questioned whether immigration judges could receive fair treatment through those government systems after Trump removed several officials overseeing federal worker complaints.

Supreme Court ultimately overturned part of that lower court ruling and sent the case back for further proceedings.

Trump Officials Celebrate the Decision

Acting Attorney General Todd Blanche praised the ruling shortly after it was released.

“This unanimous result reflects a key principle we fight for: judges should be judges resolving the case before them, and should never try to seize Congress’s role,” Blanche wrote on social media.

“This opinion sends a clear message: lower courts must accept that the law is the law, no matter the ‘political controversies of the day,’ as the Supreme Court rightly emphasized,” he added.

Critics Warn About “Unconstitutional Censorship”

Lawyers representing immigration judges reacted very differently.

Alex Abdo from the Knight First Amendment Institute criticised the ruling and warned the policy could silence important voices inside the immigration system.

“Forcing public employees to wade through cumbersome and potentially futile administrative proceedings before challenging prior restraints allows unconstitutional censorship to persist,” Abdo said.

“Now more than ever, we need the insights of the nation’s immigration judges and other public employees to understand the work of our government,” he added.

Rules at the centre of the dispute require judges to obtain advance approval before making “official” public remarks connected to immigration policy, agency programs or their professional duties.

Immigration Battles Continue to Reach Supreme Court

Fight over judicial speech restrictions arrives as Trump’s immigration policies continue piling up before the nation’s highest court.

Supreme Court has already backed several emergency immigration requests from the administration since Trump returned to office, including rulings tied to deportations and temporary protections for migrants.

Additional decisions are still expected later this summer involving Trump’s efforts to restrict birthright citizenship and revoke legal protections for thousands of Haitian and Syrian immigrants living in the United States.
